By accessing or using the HPT website, mobile apps, and related services ("Service") you agree to these Terms.

Service Description

HPT (Hockey Performance Tracker) provides tools to log, analyze, and share hockey training and gameplay metrics. Features may include integrations with Apple HealthKit and Google Fit, community features, content, and support resources.

Eligibility

You must be at least 13 years old or the minimum age required in your jurisdiction to use the Service. If you are under 18, you represent that you have parental consent.

Accounts

Provide accurate information and maintain account security. You are responsible for activities under your account. Notify us of unauthorized use.

App Stores and Billing

Paid features are billed by the Apple App Store or Google Play. Prices, taxes, and billing cycles are disclosed at purchase. Subscriptions auto‑renew until canceled in your app store settings. Access continues through the paid term; partial refunds are handled by the app store per its policies.

Lifetime Plan

"Lifetime" refers to the lifetime of the corresponding product tier, not your lifespan. We may rename, modify, or discontinue features, but you retain access to the then current Pro tier for as long as we offer that tier.

Trials and Promotions

Trials convert to paid plans unless canceled before the trial ends. Promotional terms apply as stated and may change or end.

Refunds

All purchases are final except as required by law or the app store's policy. Requests must be directed to the app store used for purchase.

Acceptable Use

No unlawful, harmful, or infringing activity. Do not attempt to access non‑public areas, interfere with operation, scrape, or reverse engineer the Service.

User Content

You may submit content such as stats, posts, feedback, and media. You grant Kytos Sports LLC a worldwide, non‑exclusive, royalty‑free license to host, store, display, reproduce, and share your content as needed to operate and improve the Service. You are responsible for your content and must have all necessary rights.

Safety and No Medical Advice

HPT provides informational tools only. It does not provide medical advice and is not a substitute for professional care. Consult a qualified professional before changing training or health routines.

Beta Program and Experimental Features

Beta Program Participation

HPT may offer beta testing programs ("Beta Program") that allow early access to pre-release versions of the Service. By applying to and participating in the Beta Program, you agree to these additional terms:

Beta Access and Duration

• Invitation Only: Beta access is granted at our sole discretion. We may accept or reject applications for any reason.
• Free Access: Beta Program participants receive free access to beta features during the testing period.
• Limited Slots: We may limit the number of beta testers to ensure quality feedback and manageable testing scope.
• Termination: We may remove you from the Beta Program at any time, with or without notice, for any reason including violation of these terms, inadequate feedback, or program capacity.
• Program End: The Beta Program will end when we launch the official version. We will notify beta testers of the transition timeline.

Beta Tester Responsibilities

As a beta tester, you agree to:

• Active Testing: Use the beta version regularly during games, practices, or training sessions as indicated in your application.
• Provide Feedback: Share constructive feedback about bugs, issues, feature requests, and user experience through designated channels.
• Report Issues: Promptly report crashes, errors, data inaccuracies, or security concerns you encounter.
• Confidentiality: While we do not require strict confidentiality for beta features, you should not misrepresent beta features as final, production-ready functionality.
• No Resale: Beta access is personal and non-transferable. You may not sell, share, or transfer your beta access to others.

Beta Software Disclaimers

IMPORTANT: Beta versions are pre-release software and are provided "AS IS" with all faults. Beta software may:

• Contain bugs, errors, or defects that cause incorrect data, crashes, or data loss.
• Change significantly or have features removed before official release.
• Not perform as accurately as the final version for metrics, tracking, or analysis.
• Be incomplete or unstable compared to production releases.
• Collect additional diagnostic data to help identify and fix issues.

Beta Data and Continuity

IMPORTANT: Beta data will be deleted when the beta program ends:

• No Data Migration: Your beta sessions, metrics, and data will NOT be transferred to the production version.
• We cannot guarantee data continuity, accuracy, or availability during the beta period.
• You should not rely solely on beta data for critical training, health, or performance decisions.
• Beta data is for testing purposes only and will be permanently deleted at the end of the beta program.
• You are responsible for exporting or backing up any information you wish to keep before the beta ends.

Feedback and Intellectual Property

Any feedback, suggestions, ideas, bug reports, or other information you provide about beta features ("Beta Feedback") becomes our property. You grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate Beta Feedback into our products and services without attribution or compensation.

Beta to Production Transition

When the beta period ends:

• Beta testers will receive advance notice of the official launch.
• You may receive special recognition, discounts, or benefits as a thank you for participating.
• Your beta access will convert to the standard free tier unless you choose to subscribe.
• Continued use after launch is subject to the then-current pricing and terms.

Experimental Features (Non-Beta)

Some features in production releases may be labeled as beta, preview, experimental, or similar designations. These features may be incomplete, change rapidly, or be withdrawn at any time without notice.

Third‑Party Services

HPT may link to or interoperate with third‑party services and app stores. Their terms and privacy policies govern those services.

Ownership

The Service, including software, branding, and content, is owned by Kytos Sports LLC and licensed to you for personal, non‑commercial use.

Feedback

If you send ideas or suggestions, you grant us the right to use them without restriction or compensation.

Termination

We may suspend or terminate access for violation of these Terms or to protect the Service. You may stop using the Service at any time. Sections that by nature should survive will survive termination.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non‑infringement.

Limitation of Liability

To the maximum extent permitted by law, Kytos Sports LLC is not liable for indirect, incidental, special, consequential, or exemplary damages. Our total liability for claims relating to the Service is limited to the greater of USD $100 or the amounts you paid in the 12 months before the claim.

Indemnification

You agree to defend and hold Kytos Sports LLC harmless from claims arising from your use of the Service or your content, except to the extent caused by our negligence or willful misconduct.

Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, excluding conflict‑of‑law rules. You consent to jurisdiction and venue in the state and federal courts located in Sheridan County, Wyoming.

Export and Sanctions

You must comply with U.S. export and sanctions laws and may not use the Service if you are barred from receiving U.S. services.

Privacy

Your use is also governed by our Privacy Policy.

Changes

We may update these Terms. Continued use after changes means acceptance. If changes are material, we will provide reasonable notice.
